1. ACCEPTANCE_OF_TERMS

By accessing or using the SafeComms API and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Bakkesplugins LLC DBA SafeComms ("SafeComms", "we", "us", or "our"). If you do not agree to these Terms, you must not access or use the Service.

2. ELIGIBILITY

You must be at least 18 years old to create an account and use the Service. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.

3. SERVICE_DESCRIPTION

SafeComms provides a developer-first content moderation API designed to detect and filter text, images, and other content types. We strive to provide accurate and reliable moderation, but we do not guarantee 100% accuracy in all detections.

4. ACCOUNT_SECURITY

You are responsible for maintaining the confidentiality of your account credentials and API keys. You are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

5. PAYMENT_TERMS

  • Payment Processing: All payments are securely processed through our third-party partner, Stripe. We do not store your payment information.
  • Stripe Support: For technical issues regarding payment processing or your payment method, you can contact Stripe directly at https://support.stripe.com. For billing inquiries related to your SafeComms subscription, please contact us.
  • Refunds: Refund requests are evaluated on a case-by-case basis. Subscribers who have utilized less than 10% of their monthly token allocation may be eligible for a full refund for the current billing period, subject to immediate subscription cancellation. For usage exceeding this threshold, any approved refunds will be prorated based on the remaining days in the billing cycle.
  • Missed Payments: If a payment fails, you will have a 4-day grace period to update your billing information. If payment is not received within this period, your service will be immediately terminated or reverted to the Free Tier.
  • Chargebacks: Initiating a chargeback will result in the immediate termination of your service.

6. DATA_AND_CONTENT

We respect your data privacy and ownership.

  • Content Processing: Content submitted to the API is securely hashed and may be retained for a period of time to enhance lookup speeds and improve performance for content we have already processed.
  • Data Sharing: We do not share, sell, or partner with third parties to distribute your content.
  • CSAM Reporting: Any content detected as containing Child Sexual Abuse Material (CSAM) will be reviewed and sent to the appropriate authorities (such as NCMEC) as part of our legal obligations to report it. You acknowledge that you have no right to privacy regarding such content.
  • Terrorism & Extremism: We reserve the right to report content identified as promoting terrorism or violent extremism to appropriate authorities if we deem it appropriate. You acknowledge that you have no right to privacy regarding such content.
  • Imminent Threats: We reserve the right to report content that we reasonably believe indicates an imminent threat to the life or safety of any person.
  • AI & Detection Models: We utilize various detection systems (including AI models) that do not store or use your submitted data for training purposes.

7. USER_CONDUCT

You agree not to use the Service for any unlawful purpose or in any way that violates these Terms. You must not attempt to reverse engineer, disrupt, or compromise the integrity of the Service. Specifically, you agree not to use the Service to probe, scan, or test the vulnerability of our systems, reverse engineer our detection logic, or use our outputs to train competing services or models.

8. TERMINATION_AND_ACCOUNT_DELETION

8.1 Termination by SafeComms

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason.

8.2 Account Deletion by User

You have the right to request deletion of your account at any time through your account settings. Upon requesting account deletion:

  • Immediate Actions: Your account access will be revoked, all active subscriptions will be cancelled, and your API keys will be deactivated immediately.
  • Grace Period: Your account will be marked for deletion with a 60-day grace period during which you may contact support to restore your account.
  • Permanent Deletion: After 60 days, your account and associated data will be permanently deleted, subject to the exceptions below.
  • No Refunds for Voluntary Deletion: Voluntary account deletion does not entitle you to a refund for any remaining subscription period or unused credits.

8.3 Data Retention for Legal Compliance

Notwithstanding any account deletion request, we reserve the right to retain your data when required by law or when subject to a litigation hold, including but not limited to:

  • Active or reasonably anticipated legal proceedings, lawsuits, disputes, or claims
  • Government investigations, audits, or regulatory inquiries
  • Compliance with valid legal process (subpoenas, court orders, warrants, etc.)
  • Detection, prevention, and investigation of fraud, abuse, or other illegal activity
  • Enforcement of these Terms or protection of our rights and property

If your account is subject to a litigation hold, data will be retained only as long as legally required. You will not be notified of such holds when notification may compromise legal proceedings or investigations. This data retention complies with applicable privacy laws, including GDPR and CCPA exceptions for legal claims and compliance.

9. DISCLAIMER_OF_WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SAFECOMMS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE SERVICE IS NOT DESIGNED OR INTENDED FOR USE IN HIGH-RISK ENVIRONMENTS REQUIRING FAIL-SAFE PERFORMANCE, WHERE A FAILURE COULD LEAD TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE.

10. GOVERNING_LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, USA, without regard to its conflict of law principles.
